Accidents do happen… but do I have a claim?

Wendy Wright looks at your compensation options, should you suffer from a workplace injury.
Many of us are not used to the idea of being able to make a claim for compensation if we are unlucky enough to have a workplace accident.
However under the law, if you suffer injury in the workplace there is a good chance you can make a claim if:
-
you are not given the right equipment for the job you are doing
-
if the equipment you are given is faulty in any way
-
if you have not been trained properly to do your job (eg you do heavy lifting and have not been instructed on the correct way to lift things)
On the building site
Did you know there are regulations, which enable you to bring an injury claim because your employers or managers did not carry out a risk assessment of your work?
Or if they did not take the necessary precautions to make your system of work as safe as possible?
If you work from scaffolding of above ground level you may have particularly strong grounds for a claim.
In the office
If you trip over something at work, or slip on something and get hurt, you might have a claim against your employers.
This can include tripping over electric cables on the floor that should have been tucked away or slipping on liquid that should have been mopped up.
Some successful claims
Osbornes have successfully brought claims against employers when:

an employee slipped on a wet surface while carrying furniture

an employee on a building site slipped on wet plaster that had been left on the stairs

an employee on a building site fell through a hole that had not been fenced off
These are just some examples – there are many more when it was not so obvious that a claim could be brought.
You can claim for:

pain and suffering

earnings lost because of the accident

expenses which resulted from the accident, including things like taxi fares and the cost of prescriptions

private medical bills

Successful claims can often amount to many thousands of pounds.
