Judge rejects insurers' claim car was 'too slow' to cause whiplash
A women who suffered a modest whiplash injury in a so-called 'low velocity impact' road traffic accident wins damages
The claimant sustained a modest whiplash injury. The defendant's insurers alleged that their driver was travelling too slowly to have caused the Claimant any injury (a so called 'Low Velocity Impact' case).
The defence served ‘expert’ scientific evidence and alleged fraud against her. The case went to trial in the County Court. The judge accepted her evidence and awarded her £1200 in damages.
